Patents in Bangladesh

Bangladesh is member Paris Convention, therefore, it is possible to file Patent Application with conventional prority in Bangladesh with priority claims. Bangladesh is not member of PCT therefore filing national phase is not possible, and if 12 months deadline is over,  it is possible to file an application without prioirty claim. The total term of Patent is 20 years in Bangladesh.

Patent filing requirements in Bangladesh:

  1. Name, address and nationality of the Applicant (s) and inventor (s)
  2. Complete Specification in English (comprising description, claims, abstract and formal drawings, if any)
  3. Original POA within 1 month of filing application 
  4. Proof of right: Signed declaration in presence of 2 witnesses or duly notarised assignment deed within 3 months of filing application in India
  5. Priority details (including  Patent Application number, date and country of origin) where priority is claimed. Certified copy of priority document  must be filed within 3 months of filing of Patent Application in Bangladesh 
  6. Verified/ notarised English translation of the priority document if priority document is in any language other than English must be filed within 3 months of filing of Patent Application in Bangladesh.

Patent prosecution in Bangladesh:

  1. Filing Of Patent Application
  2. Formality Check
  3. Publication of Application after 18 months unless request for early publication is filed
  4. Pre-grant Opposition within 90 days of publication
  5. Examination: Filing request for examination within 36 months from filing date, a 3 months extension available if sought before expiry of said period  
  6. Substantive examination of Application, includes filing reply and seeking hearing if required
  7. Publication and Opposition within 90 days of publication
  8. Sealing fee payment and Grant of Patent, after payment of Sealing/ Grant fee; if there is no opposition or if the opposition has been decided in favour of Applicant
  9. Issuance of Letter Patent document
  10. Payment of renewal fee to keep the Patent in force

Term of Patent:

The total term of Patent is only 20 years and annuity if payment from 6th year onwards to be paid before expiry of 5th year.
